Introduction

ICMS’s policy on protecting personal data
ICMS Solutions Co.,Ltd. and International Certificate authority of Management System Co.,Ltd. (“ICMS Group”) recognize that protecting personal information is a critical issue and agree to share personal information only with extreme care to maintain confidentiality. To pay careful attention to the handling of all personal data that ICMS Group obtains, we will comply with the following Personal Information Protection Policy.

“Personal Information and Customer Information” in this policy means personal information that can identify you by itself or in combination.

2. Basic Principles Concerning the Handling of Personal Information

  1. Executives and employees of ICMS Group will strictly enforce this policy in an effort to prevent the leakage, tampering, loss, and/or unauthorized access of information.
  2. Manage customer information in an accurate and up-to-date manner. However, past information is retained to manage usage history.

  4. Identify and clarify the purpose of use of personal information to be acquired to the greatest extent possible.
  5. Personal information shall be used within the scope of the purpose of use and within the scope of business necessity by an authorized person in accordance with the necessary work.
  6. When sharing personal information with ICMS Group, identify and clarify as much as possible the necessary items such as the purpose of use.

3. Means of protecting personal information

  1. In the event personal information processing is entrusted, appropriate management shall be undertaken, such as obligatory contractual arrangements, to prevent leaks and the like from occurring.
  2. When discarding documents containing customer information, we will shred them or dispose of them in such a way to prevent leakage.

4. Intended use of personal information

ICMS Group collects and uses your personal data to provide and improve services and to ensure proper promotional activities, in accordance with the following objectives:

  • Application for services
  • Questions, responses, and notifications associated with the service
  • Research to improve services and develop new services
  • Questionnaire Survey on Satisfaction and Policies
  • Sending various information via e-mail magazine, direct mail, facsimile, etc.

In the event ICMS Group wishes to use personal information for any purpose other than the above, the prior approval of the customer shall be obtained.

5. Disclosure of Personal Information to Third Parties

  • In accordance with laws and regulations
  • When it is necessary to protect the life, body, or property of a person and it is difficult to obtain the consent of the customer
  • When it is particularly necessary for improving public health or promoting the healthy development of children and it is difficult to obtain the consent of the user
  • Cases in which it is necessary to cooperate with a state organ, a local government, or an entity entrusted thereby in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the customer is likely to hinder the execution of the relevant affairs

6. Scope of responsibility for the protection of personal information

Web sites in ICMS Group contain links to other sites, but the content and functions of linked sites are not managed by ICMS Group. ICMS Group will not be responsible for managing any information you have entered on any web site outside of administrative privileges.

7. Governing Law and Agreed Jurisdiction

  1. Any customer accessing ICMS Group website is subject to local laws and regulations.
    If any dispute arises between ICMS Group and the Customer, ICMS Group will consult with the Customer in good faith.
  2. .If no agreement is reached, Tokyo Summary Court or Tokyo District Court shall be the exclusive jurisdictional court of first instance.
